eTail Pet, Inc. (the “Company,” “us,” “we” and words of similar import) operates, hosts and manages an eCommerce and POS platform for pet store owners (collectively, the “Service”), which includes the website located at www.etailpet.com (the “Website”). Capitalized terms used herein, which are otherwise undefined, have the meanings attributed thereto in the Company’s Terms of Service which can be found https://www.etailpet.com/terms-service/ (the “Terms of Service”).
Persons Under the Age of 18
Our Service is not intended for persons under 18 years of age. No one under age 18 may provide any information to or on the Service. We do not knowingly collect personal information from persons under 18. If you are under 18, do not use or provide any information on the Service or on or through any of its features. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Information We Collect
When you use the Service, we may collect information about you or your use of the Service. Such information includes (but is not limited to):

- Location: information about your Internet connection, the equipment you use to access our Service and usage details; the geo-location of your device (using GPS or other geo-location data), when location services have been enabled for the browser accessing our Service; and

- Log Data: log information, including the app or website visited, the time and your time zone, network connection type (e.g., WiFi, cellular), and cookie information;
- Third Party: non-personally identifying information that third parties have collected and share with us to help better provide the Service.
Information We Collect Directly From You
We collect this information directly from you when you provide it to us, or as we process your transactions, for example:
- information that you provide by filling in forms on our Service, including information provided at the time of registering to use our Service or requesting further services relating to the Service or your use of the Service;
- records and copies of your correspondence (including email addresses), if you contact us; and
- details of transactions you carry out through our Service.
Information We Collect From Third Party Data
As you interact with our service, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including use of our service i.e. including traffic data, location data, logs and other communication data and the resources that you access and use on the Service; and information about your device and Internet connection.
The information we collect automatically is statistical data and does not include personal information. It helps us to improve our Service and to deliver a better and more personalized service, including by enabling us to:
- estimate our audience size and usage patterns;
- store information about your preferences, allowing us to customize our Service according to your individual interests; and

Accessing and Correcting Your Information
You can review and change your personal information by logging into the Service and visiting your account profile page. You may also send us an email to firstname.lastname@example.org to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
Data Collection Technologies
Other Technologies. The Service, including certain web pages on our Website, and our emails may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
Stored Information and Files. The Service also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts and address book information.
We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction and information you post to publicly available areas of the Service.
We may disclose personal information that we collect or you provide as described in this Policy:
- to fulfill the purpose for which you provide it;

- to contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them;

Your California Privacy Rights

The rest of this section provides additional details about the personal information we collect about California consumers as well as the rights of California consumers under the California Consumer Privacy Act (CCPA).
- Your CCPA Rights and Choices. As a California consumer and subject to certain limitations under the CCPA, you have choices regarding our use and disclosure of your personal information:
- Exercising the right to know. You may request, up to twice in a 12-month period, the following information about the personal information we have collected about you during the past 12 months:
- the categories and specific pieces of personal information we have collected about you;
- the categories of sources from which we collected the personal information;
- the business or commercial purpose for which we collected the personal information;
- the categories of third parties with whom we shared the personal information; and
- the categories of personal information about you that we disclosed for a business purpose, and the categories of third parties to whom we disclosed that information for a business purpose.
- Exercising the right to delete. You may request that we delete the personal information we have collected from you, subject to certain limitations under applicable law.
- Exercising the right to opt-out from a sale. You may request to opt out of any “sale” of your personal information that may take place. We do not use, share, rent or sell the personal data of our users’ customers for interest-based advertising. We do not sell or rent the personal data of our users, their customers or our site visitors.
- Non-discrimination. The CCPA provides that you may not be discriminated against for exercising these rights.

We may need to verify your identity before responding to your request, such as verifying that the email address from which you send the request matches your email address that we have on file. Authentication based on a government-issued and valid identification document may be required. If you are a customer of an eTail Pet user, please direct your requests directly to the eTail Pet user with whom you shared your personal information.
We have implemented measures designed to provide confidentiality, integrity, and security of your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We will use commercially reasonable efforts to safeguard the information that you submit to us.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We strong suggest the use of malware/antivirus scanning of your devices that you use to access the service.
Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Service. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Service.
Legal Process, Safety and Terms Enforcement
We may disclose personal information to governmental regulatory authorities in response to their requests for such information or to assist in investigations. We may also disclose personal information to third parties in connection with claims, disputes or litigation, when otherwise required by law, or if it is determined its disclosure is necessary to protect the health and safety of the User or the Company, to protect against fraud or credit risk, or to enforce legal rights or contractual obligations.

We process all personal information in line with User’s rights in each case to the extent required by and in accordance with applicable laws, time limits, and fee requirements.
We retain personal information only for as long as necessary to perform business services and thereafter for a variety of legitimate legal or business purposes. These might include retention periods:
- Mandated by law, contract or similar obligations applicable to business operations.
- For preserving, resolving, defending or enforcing legal and/or contractual rights.
- Needed to maintain adequate and accurate business and financial records.
We will post any changes we make to this Policy on this page. If we make what we believe is a material change to this Policy, we will notify our registered Service users by email to the email address specified in each User’s account or through a notice on the Service home page. The date this Policy was last revised is identified at the top of the page.
